Terms of Use

Welcome to MimiTalk. These Terms of Use ("Terms") govern your access to and use of the MimiTalk mobile application (the "App"), operated by MimiTalk, a sole proprietorship registered under India's Udyam (MSME) scheme, based in Thiruvananthapuram, Kerala, India ("MimiTalk," "we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Eligibility
You must be at least 13 years old to use MimiTalk. If you are under the age of majority in your country, you may only use the App with the involvement of a parent or legal guardian.
2. Description of Service
MimiTalk is a listening-first English learning application that provides audio-based lessons organized into categories and lessons. Some content is available free of charge; additional content may be offered through in-app purchases or subscriptions, as described in Section 5.
3. Accounts
To access certain features, you may need to create an account. You agree to provide accurate information when creating your account, keep your login credentials secure, and notify us if you believe your account has been accessed without authorization. You may delete your account at any time through the in-app account deletion feature or via the request process described above.
4. Acceptable Use
You agree not to use the App for any unlawful purpose; attempt to reverse-engineer, decompile, or extract the App's underlying code or audio content for redistribution; copy, resell, or redistribute MimiTalk's lessons, audio recordings, or written content without our permission; or interfere with or disrupt the App's functioning or servers.
5. Purchases and Subscriptions
Some lessons and features may be offered as paid in-app purchases or subscriptions. All payments are processed through Google Play Billing. Purchases, refunds, and cancellations are subject to Google Play's own refund and billing policies. MimiTalk does not directly process payments or issue refunds outside of Google Play's systems.
6. Intellectual Property
All lessons, audio recordings, text, graphics, logos, and other content within the App are the property of MimiTalk and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use this content for personal, non-commercial learning purposes only.
7. Free Content and Changes to the App
We may add, modify, or discontinue lessons, categories, or features at any time, including changing which content is free or paid. We will make reasonable efforts to communicate significant changes, but we do not guarantee that any specific lesson or feature will remain available or free indefinitely.
8. Termination
We reserve the right to suspend or terminate your access to the App if you violate these Terms. You may stop using the App and delete your account at any time.
9. Disclaimer of Warranties
The App is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that it will meet your specific learning goals or outcomes.
10. Limitation of Liability
To the fullest extent permitted by law, MimiTalk shall not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the App.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
12. Governing Law
These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in Thiruvananthapuram, Kerala, India.
